The limitations, exclusions and disclaimers set out herein shall apply whether an action, claim or demand arises from breach of warranty or condition, breach of a fundamental term or fundamental breach, breach of contract, strict liability, indemnity, tort (including negligence), or any other kind of legal or equitable liability.
